Terms and Conditions (T&C)

§1 Scope and Contracting Parties
(1) These General Terms and Conditions apply to all orders placed via the online shop Glow Nest.

(2) The contracting party is:

(3) Our offer is directed at both consumers and businesses.

§2 Products and Custom Production
(1) Glow Nest offers high-quality wallpaper, which is produced individually according to the measurements provided by the customer.

(2) The customer enters the desired width and height via the product configurator. The wallpaper motif and its pattern repeat are adjusted according to the selected dimensions.

(3) The wallpapers are produced individually only after the order is received. These are not pre-manufactured stock items.

(4) The customer is obliged to carefully verify the entered measurements before completing the order.

(5) Minor color deviations between the screen display and the print result due to technical reasons are possible. Statutory warranty rights remain unaffected.

§3 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a binding offer.

(2) The customer selects their desired wallpaper design, enters the individual measurements, and places the product in the shopping cart.

(3) Before completing the order, the entered data can be reviewed and corrected.

(4) By clicking the button "Order with obligation to pay" or a similarly clearly labeled button, the customer submits a binding purchase offer.

(5) The purchase contract is concluded upon our express acceptance of the order or by shipping the goods.

(6) The contract language is German.

§4 Prices and Payment
(1) All prices are stated in Euros.

(2) Due to the small business regulation according to §19 UStG (German Value Added Tax Act), no VAT is shown.

(3) Any additional shipping costs are displayed before the order is completed.

(4) Payment is made via the payment methods offered at checkout.

§5 Production and Delivery
(1) All wallpapers are manufactured individually according to the dimensions specified by the customer by our production partner.

(2) The applicable delivery time is stated in the online shop before the order is completed.

(3) Delivery is made to the delivery address provided by the customer within the offered delivery areas.

(4) Shipping costs are displayed at checkout.

(5) In case of delivery delays, we will inform the customer immediately. Statutory rights remain unaffected.

§6 Right of Withdrawal
(1) Our wallpapers are custom-made according to the measurements provided by the customer. The motif and its pattern repeat are adjusted according to the selected dimensions.

(2) For these custom-made wallpapers, there is no statutory right of withdrawal in accordance with § 312g Para. 2 No. 1 BGB (German Civil Code), provided the statutory requirements are met.

(3) Statutory warranty rights for defective goods remain unaffected by this.

§7 Warranty and Complaints
(1) Statutory warranty rights apply.

(2) In case of damaged, defective, or non-conforming wallpapers, the customer can contact glownest.store55@gmail.com stating their order number.

(3) For faster processing, photos of the defect can be submitted. This is not a prerequisite for asserting statutory claims.

(4) In the case of justified defects, the customer is entitled to statutory rights regarding supplementary performance and, if applicable, further statutory claims.

§8 Retention of Title
The goods remain the property of Glow Nest until full payment has been received.

§9 Liability
(1) We are fully liable for intent, gross negligence, as well as damages resulting from injury to life, body, or health.

(2) In the event of a slightly negligent breach of essential contractual obligations, we are liable for the foreseeable damage typical for the contract.

(3) Liability under the Product Liability Act and mandatory statutory liability provisions remains unaffected.

§10 Applicable Law
German law applies, excluding the UN Sales Convention. For consumers, mandatory protective provisions of the state of their habitual residence remain unaffected.

§11 Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a legal obligation to do so.

§12 Final Provisions
Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions remains unaffected. Statutory regulations shall apply in place of invalid provisions.
